Magotteaux understands that your privacy is important to you and that you care about how your personal data is used. In this Privacy Notice, we therefore describe how we collect, use and store your personal data.

Please rest assured that in processing your personal data, we commit to comply with all applicable laws and regulations regarding data protection, such as the General Data Protection Regulation 2016/679(“GDPR”).

This notice has been prepared  in the English language and may be translated into other languages. If there is any conflict or inconsistency between the English language version and any translation thereof, the English language version will prevail.

2. What does this Notice cover?

This Privacy Notice explains how we use your personal data: how it is collected, how it is held, and how it is processed. It also explains your rights in relation to the processing of your personal data.

It mainly covers the collection and processing of personal data of people who visit our website or who have expressed an interest in Magotteaux and its activities (e.g. subscribers to newsletters or those registering to events we organise or co-organise), as well as people that Magotteaux engages with in the framework of its mission and activities, unless a specific privacy notice has been released to supplement it or to replace it. Please note in this respect that a specific privacy notice (available on the Career Page of the website) applies to candidates who apply for a job at Magotteaux.

4. How do we collect personal data?

Magotteaux will collect your personal data:

  • when you directly provide us with your personal data (e.g. when you contact us via email, contact forms or other means of communication);
  • when we receive personal data from third parties (e.g. personal data received from regulatory authorities, customers or service providers of Magotteaux);
  • when personal data is collected automatically (e.g. your technical information in relation to the use of the website).

5. What personal data do we collect?

Depending on the purpose for which we process your personal data, we may process different categories of personal data. In general, and depending on the specific case, this may include the following:

  • Identification and contact data: e.g. first name, last name, email address, company name, country location, or other relevant details.
  • Interactions and correspondence: e.g. the subject and content of your message, and your preferences concerning the newsletter.
  • Commercial information: information relevant to the services we provide you with, such as billing information or information in relation to your business;

6. Why do we process your personal data, and on which legal ground?

We process your personal data for the following purposes, and on the following legal bases:

  • Customer support: We use your data to respond to the requests and queries you raised to us through the different contact channels, including by filling in a form on our website. The use of your personal data for that purpose is based on our legitimate interest o assist you adequately (Article 6 (1)(f) GDPR).
  • Marketing: We process your personal data to manage your subscription to the newsletter, including to send customized information about our services or solutions and our new events to come. We will only provide you with direct marketing e-mails after we have obtained your prior explicit consent to receive such marketing communications (Article 6 (1)(a) GDPR). Please remember that you may unsubscribe from the newsletter at any time and without any cost.
  • Business operation: We may have to process personal data in the course of the delivery of our services or in the operation of our business relationship, e.g. to enforce our agreements with you. As an example, when you register for an event organised by Magotteaux, we collect the personal data that is necessary for processing your registration for the event and to send you the proof of registration. To the extent this processing requires the processing of your personal data, we rely on the performance of our agreement with you (Article 6(1)(b) GDPR).
  • Website maintenance: We gather technical data to optimize the quality of our services and functionality of our website. Some information related to your visits are collected in an aggregate way. We can access statistics provided by website analytics tools in order to have information on the way our website is consulted. We rely on our legitimate interest as lawful basis (Article 6 (1)(f) GDPR). Our legitimate interest in this data processing lies in the evaluation of the data to improve our website and keep it safe and secure.

Magotteaux will not use your personal data for purposes that are incompatible with the purposes of which you have been informed, unless it is required or authorised by law to do so.

7. How long will we keep your personal data?

We will only retain your personal data for as long as your relationship with Magotteaux persists (e.g. if you are a contractual party or a newsletter subscriber) and as necessary to fulfil the purposes described in section 6 above. This is without prejudice to specific limitation periods foreseen by law allowing to conserve personal data for longer periods of time.

8. With whom do we share your personal data?

In certain cases, your personal data may be transferred to, or be accessible by, third parties on a need-to-know basis, namely:

  • To other firms from the Magotteaux group. As we are part of a global network with member firms around the world (each of which is a separate legal entity), personal data submitted to us may be transferred to other member firms of the Magotteaux group where this is necessary to meet the purpose described in section 6 above.
  • To sub-contractors in the framework of activities linked to the mission of Magotteaux. For example, we use third parties to support us in providing our services and to help provide, run and manage our internal IT systems. 
  • To the competent authorities or any other legal entities. We may also disclose personal data to respond to requests of the courts, governmental authorities or where it is necessary or prudent for compliance with applicable legislation or for exercising or defending legal rights.

When we share data with third parties, we will, whenever required, put contractual arrangements in place to protect the data and to comply with our data protection obligations.

Personal data may be transferred to countries outside the European Economic Area (EEA). Where this occurs, we ensure that appropriate safeguards are in place to protect your personal data and that such transfers are carried out in accordance with applicable data protection laws. If personal data is transferred to a country that has not been recognised by the European Commission as providing an adequate level of protection (adequacy decision), the transfer will be subject to appropriate safeguards, such as the European Commission–approved Standard Contractual Clauses and/or supplementary measures, as required.

9. How do we protect your personal data?

Magotteaux takes all reasonable steps (physical, technical and organisational safeguards) to protect your personal data against accidental or unlawful destruction or accidental loss, alteration, unauthorised disclosure or access, and against all other unlawful forms of processing. Examples of such measures are the implementation of a secure IT infrastructure, the conclusion of data processing agreements with third parties and the restriction of access to personal data to authorized persons only. Any person who does have access to your personal data is under an obligation to keep such information confidential.

We update and test our security measures on an ongoing basis.

10. What are your rights?

According to the regulations on the protection of personal data, you have the following rights:

  • Access. You have the right to obtain confirmation as to whether or not your personal data are being processed, and, where that is the case, to receive information about such processing and a copy of the data being processed.
  • Rectification. You have the right to request the correction of incomplete or inaccurate data about you.
  • Deletion. You have the right to obtain the request the erasure of your personal data in the situations set forth by applicable data protection laws (also known as “right to be forgotten”).
  • Restriction. You have the right to restrict processing of data under certain specified circumstances.
  • Objection. You have the right to object to the processing of your data. We will assess your request, taking into account whether there are compelling legitimate grounds to continue processing or whether the data are required for the establishment, exercise, or defense of legal claims.
  • Data portability. You have the right to request the receipt of your personal data, or its transfer to another organization, in a structured, commonly used, and machine-readable format.
  • Right to withdraw consent. When you have given your consent for the processing of your data (e.g. subscription to a newsletter), you can withdraw it at any time and without justification.
  • Automated decision-making. You have the right to request human intervention when a decision that will significantly affect you is solely based on automated processing.
